3 Lesbian women in court for beating up a homosexual man

Three women identified by their lawyers as lesbians were arraigned yesterday on a hate crime charge for allegedly beating a homosexual man at the Forest Hills T station in an unusual case that experts say exposes the law’s flawed logic. “My guess is that no sane jury would convict them under those circumstances, but what this really demonstrates is the idiocy of the hate-crime legislation,” said civil liberties lawyer Harvey Silverglate. “If you beat someone up, you’re guilty of assault and battery of a human being. Period. The idea of trying to break down human beings into categories is doomed to failure.”

Prosecutors and the ACLU of Massachusetts said no matter the defendants’ sexual orientation, they can still face the crime of assault and battery with intent to intimidate, which carries up to a 10-year prison sentence, by using hateful language.  “Someone who is Jewish can be anti-Semitic,” said ACLU staff attorney Sarah Wunsch. “The mere fact that someone is a member of the same class doesn’t mean they could not be motivated by hatred for their very own group.” But Carolyn Euell, 38, mother of two of the defendants, Erika Stroud, 21, of Dorchester and Felicia Stroud, 18, West Roxbury, told reporters the alleged attack “can’t be hateful” because both her daughters are lesbians.

Boy, 14, shoots his mother dead as she slept after she tried to keep him away from a gang

A 14-year-old boy shot his mother ‘at least ten times’ as she slept on the couch. The teen, named by family members as Joshua Smith, from east Detroit, allegedly unleashed a hail of bullets on Tamiko Robinson, 36, in the early hours of Monday morning, according to a police spokesman. Smith, who was on the swimming team at Kettering High School, was said to be angry that his mother had tried to keep him off the streets and away from a gang.

Smith’s uncle LeShaun Roberts, told Fox Detroit News the teen had wanted to ‘hang with the big boys’ – gang members in their twenties – but when his mother said no he ran away to relatives. But Robinson, a dialysis patient, who was battling lupus, went after her son and insisted he came home, angering the youngster. ‘He broke into his step dad’s room, got a twelve gauge and brutally murdered my sister,’ Roberts said. ‘He shot at least ten times.  ‘He just shot. Every chance he got a chance to shoot again, he shot again, and there’s just buckshot, holes everywhere.’

The bullets left holes in the windows. Robinson’s five-year-old daughter and her fiance, named in reports as Chiko Lewis, were also in the home at the time and were forced to jump out of a low window to escape the gunfire. The little girl later asked relatives: ‘why would someone want to hurt mommy?’ Smith was arrested soon after the shooting. He had reportedly been driving around in his mother’s car. Roberts, who was holding a framed portrait of the family, added: ‘He (Smith) said his mother won’t let him have friends, he said his mother won’t let him bring his girlfriends over, his mother won’t let him stay out until 11 o’clock at night. He’s 14 years old.’

Fight at a baby shower gets nine month old baby boy shot and killed

A nine-month-old boy was shot dead as he slept after his mother became swept up in a fight at a baby shower, the tot’s grandmother has claimed. Delric Miller IV was killed after gunmen sprayed bullets into his home in the west side of Detroit, Michigan while he slept on the couch. The child’s grandmother believes the shooting was retaliation for a row over seating at a baby shower, attended by her daughter Diamond Salter. ‘The shower was overbooked, and there was an argument because there weren’t enough seats,’ Cynthia Wilkins told the Detroit News. She said that a woman became enraged when she was unable to find a seat and began knocking over tables.  Ms Salter and her friends left the venue, she said, but they were followed by a group of men and women. A fight broke out at a gas station.

‘They followed them to the house,’ Ms Wilkins said. ‘I think they came back the next day and shot up the house.’ She added: ‘They went to the shower to celebrate life; instead, a life was destroyed.’ Police believe a minivan pulled up outside the house on the 8400 block of Greenview Avenue at 4.30 a.m. on Monday, and a gunman jumped out. He used an AK-47-type rifle to shoot 37 bullets into the front of the property, police said. The house, occupied by ten people at the time, was left riddled with bullet holes. Ms Wilkins told Fox News: ‘How dare they? They didn’t care who they killed, how many children were in here. They didn’t care about nothing.’  The sleeping tot was hit by one of the rounds and pronounced dead at Sinai-Grace Hospital. The incident is under investigation by the FBI, the Bureau of Alcohol Tobacco Firearms and Explosives and the Wayne County Sheriff’s Office.

Authorities are searching for two men – whom they branded ‘cold-blooded killers’ – in connection with the killing. ‘Again, adult behavior has brought another child in Detroit to an end,’ Police Chief Ralph Godbee said at a press conference. ‘It’s actually amazing that more people in that house were not killed. There’s no question about it. This is gang-related.’ Wilkins, who also lost a daughter in a drive-by shooting ten years ago, added: ‘Life is not valued in Detroit. It’s a war zone here.’ Delric’s death was the 43rd homicide in Detroit this year, up from 35 in the same period last year. A funeral will be held for him on Monday. The family has appealed for donations as they are struggling to fund the service, Fox reported.

Fatal shootout nets gang member life plus 26 years

A Knox County judge Thursday ensured the death behind bars of a man who killed an innocent bystander in what a prosecutor described as a “wild, wild west” shoot-out in a populated area of East Knoxville. Richard Cleophus Smith, 21, was already facing a life sentence — 51 years of which are mandatory — for the July 2009 shooting death of innocent bystander Ronald Gilmore, 29. On Thursday, Criminal Court Judge Mary Beth Leibowitz stacked another 26 years onto that life sentence for Smith’s lesser convictions in trying to kill his intended target, a rival gang member. “Mr. Smith was engaged in a gang war, if you want to call it that,” Leibowitz said. “There were many victims out there that day. Nobody had any regard for anyone who could have been victimized by this.”

Assistant District Attorney General Kevin Allen said Gilmore was walking to a store on McConnell Avenue when he was struck by bullets Smith was firing from two assault-style weapons during a gunbattle in the Walter P. Taylor Homes housing project with Desmond Cowan. “You’ve got somebody who just doesn’t care, who treated Walter P. Taylor as the wild, wild west,” Allen said of Smith. Defense attorney Wesley Stone argued that while Gilmore was an innocent bystander, Cowan was not. Stone urged Leibowitz not to add any time to Smith’s life sentence in Gilmore’s death for the attempted murder of Cowan. Smith was fired upon first and he fired back,” Stone said. Smith denied trying to kill Cowan and pointed to the firepower Smith was packing as proof. “You saw them guns, your honor,” Smith said. “If I had intended to kill someone, they would be dead.”

Mother to stand trial for microwaving her baby to death

A mother will stand trial on charges of killing her seven-week-old daughter by placing her in a microwave oven and letting her burn to death for two minutes. As well as the murder accusation against Ka Yang, 30, from California, Sacramento County Superior Court Judge Eugene Balanon also found enough evidence to support a special allegation that she tortured her daughter, Mirabelle.

Prosecutors ruled out the death penalty, but Yang faces life in prison without the possibility of parole if convicted of the murder of her child. The mother-of-four has been held since June after investigators determined her baby died of ‘extensive thermal injuries’ after being placed in a microwave on March 17.

A pathologist testified during Tuesday’s hearing that the radiation from the microwave essentially cooked the child’s stomach and small intestine.

Yang’s defense attorney, Linda Parisi said that it was due to her client’s history of seizures – which she has been suffering from for more than six years – that made her put her own baby in the microwave.

She will argue during the murder trial that Yang was in the middle of a seizure and did not know what she was doing.

At the time, Yang claimed she ‘had a seizure and did not know what happened after that’.

When they happen, she ‘sees white light and then trees before hand’, according to her family.
